TO: BOWEN ISLAND LEARN TO SAIL SOCIETY (Course Provider) and TUNSTALL BAY COMMUNITY ASSOCIATION (Facility Owner) (collectively referred to as the "RELEASEES"): ASSUMPTION OF RISKS I am aware that participating in any Learn To Sail courses or sailing activities involves many risks, dangers and hazards including, but not limited to: boarding, riding and disembarking ; boat capsizing, throwing occupants into cold water; the nature of the beach; weather extremes, including sudden and unexpected changes; dangerous water conditions, including cold water and movement, waves, currents, rapids and white water; changes in the water depth; impact or collision with natural and man-made objects or equipment used in connection with boat sailing, including mast booms, ropes and sheets, boat or dock fixtures, docks, marine life, rocks and other boats; bringing unsafe or inappropriate personal safety equipment; equipment malfunction or failure; overexertion and failure to participate safely within one’s ability or physical condition or lack of conditioning or fitness; risk of bodily injury including physical impairment and serious disability; participating with or without a certified instructor; impact or entanglement with obstructions, apparatus, equipment, surfaces or walls; defective, dangerous, or unsafe condition of the facilities or equipment; loud amplified music or instruction; contact or collision with equipment, props, instructor or other participants; theft; consumption of food and drink, whether made by professionals or by non-professionals; negligence of other participants and non-sport club members; cancellations; contraction of a contagious disease including, but not limited to, COVID-19 and NEGLIGENCE ON THE PART OF ANY OF THE RELEASEES OR ITS EMPLOYEES, BOARD OR VOLUNTEERS, INCLUDING THE FAILURE ON THE PART OF ANY OF THE RELEASEES OR ITS EMPLOYEES, BOARD OR VOLUNTEERS TO SAFEGUARD OR PROTECT ME, MY CHILD, OR GUARDIAN WARD, FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE. I am also aware that the risks, dangers and hazards referred to above exist within a variety of facilities whether on the beach, boathouse or water, including but not limited to: recreational ground, roadways, parking areas, clubhouse, boathouse, dock, beach, toilets and other facilities. I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH ME, MY CHILD, OR GUARDIAN WARD, PARTICIPATING IN ANY LEARN TO SAIL SAILING ACTIVITIES AND COURSES, AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM. I am also aware that none of the RELEASEES carry accident or medical or dental insurance on my behalf. RELEASE OF LIABILITY, WAIVER OF CLAIMS In consideration of the RELEASEES allowing me, my child or guardian ward, to participating in any Learn To Sail sailing activities and courses and permitting me, my child or guardian ward use of their equipment, structures and other facilities, and for good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows: • TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the RELEASEES, their Boards of Directors, officers, employees, agents and representatives, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, resulting from me, my child or guardian ward participating in any Learn To Sail sailing activities or courses DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING BUT NOT LIMITED TO ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c. 337, ON THE PART OF THE RELEASEES, AND ALSO INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME, MY CHILD OR GUARDIAN WARD FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE; 1. This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction; and 2. Any litigation involving the parties to this Agreement shall be brought solely within the Province of British Columbia and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia sitting in Vancouver. By participating in this course you: (a) grant the organizing authority (the Bowen Island Learn To Sail Society), event sponsors and affiliates the right, in perpetuity, to make, use, and show, at their discretion, any photography, audio and video recordings, and other reproductions of them made at the venue or on the water from the time of their arrival at the venue until their final departure, without compensation. (b) grant the organizing authority (the Bowen Island Learn To Sail Society) permission to use, at their discretion, any photography, audio and video recordings for use in online promotional materials including website content and/or social media (e.g. Facebook, Instagram, YouTube) and/or in printed promotional materials such as brochures, event posters or other promotional material which the Bowen Island Learn To Sail Society may use to encourage other use to participate in Learn To Sail programs or events. (a) to (b) above] In entering into this Agreement I am not relying upon any oral or written representations or statements made by any of the RELEASEES with respect to the safety of the participating in any Learn To Sail sailing activities or courses other than what is set forth in this Agreement. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY CLICKING THE TERMS OF SERVICE BUTTON TO THIS AGREEMENT, OR SIGNING BELOW, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY CHILD OR GUARDIAN WARD AND OUR HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
